In a fresh attack on Center, the chief justice of india,  T. S. Thakur, has expressed in the strong words openly before the media that the BJP government must not sit on judicial appointments of about 500 judges in high courts that were sent to the government. The Courts are there but Judges are missing! He added that 500 High Court judges who must be working today are not working because of Indian government's unreasonable attitude.

The union law minister and attorney general retaliated in equally strong words that the judiciary must not cross its LAKSHMAN REKHA (ethical limit of an action). Law minister Ravi Shankar Prasad disagreed and said that his government has appointed 120 judges this year he has raised a big question that in lower courts there are about 5000 vacancies wherein Govt of India has no role at all. Judiciary could have taken care of that. Attorney General Mukul Rohatgi has commented sharply that the judiciary needs to introspect itself. The sacred boundaries must not be crossed. Justice Jagdish Khehar justified by saying, ""Judiciary is expected to shield all citizens against abuse of state's power. If this armour is stripped, then the door is open to nullification and anarchy."

Two important pillars of democracy indulge in war of words


It is widely known that Indian government had desired its stake in judicial appointments with a proposal of NATIONAL JUDICIAL APPOINTMENTS COMMISSION that was eventually stricken off by the supreme court of India after a prolonged debate between the government and Supreme Court and the judiciary stuck to the old Collegium system through which the appointments have been made in the past. Actually Collegium system has accorded complete independence to Judiciary which the government of India wishes to control to certain extent and that perhaps would never happen. This encroachment on Judiciary's independence should never take place or else justice may get distorted in favor of the government.

  2. Shital sir..Indian prisons are super over crowded. Especially the undertrials are waiting for years for their first hearing just because there are no enough Judges in our judicial system across India. Justice delayed is justice denied. Instead of political gain Govt. must do something concrete to expedite the appointment of Judges.

    1. Thanks for your views and I see there is substance and truth in it. BJP can delay the appointments of Judges but can not stop it as it will have to surrender before the Supreme Court of India in the end. We have seen it happening in the past too on various other imp issues. Just wait and watch.
